Terms and conditions

Introductory Provisions
These General Terms and Conditions (hereinafter referred to as the "GTC") are effective from 1 October 2020 and govern the mutual rights and obligations arising between the contracting parties in connection with purchases made in the online shop www.airsoftshop.cz, operated by Jan Šulc – Bohemia Air Soft, Lánovská 1550, 190 16 Praha 21 – Újezd nad Lesy, Company ID No. (IČ): 64768830 (hereinafter referred to as the "seller").

The GTC further define and specify the rights and obligations of the seller and the buyer (a customer who is a consumer or a customer who is not a consumer).

A consumer is any natural person who, outside the scope of their business activity or outside the scope of the independent exercise of their profession, enters into a contract with the seller or otherwise deals with the seller. A buyer who is not a consumer is an entrepreneur. An entrepreneur is also deemed to be any person who enters into contracts in connection with their own commercial, manufacturing or similar activity or in the independent exercise of their profession, or a person who acts in the name or on behalf of an entrepreneur. If the buyer states their Company ID No. (IČ) in the order, they acknowledge that the rules set out in the GTC for entrepreneurs automatically apply to them.

The seller is an entrepreneur and, when concluding and performing the purchase contract, acts within the scope of their business activity.

All contractual relationships are concluded in accordance with the legal order of the Czech Republic. If the buyer is a consumer, relationships not governed by the GTC are governed by the Civil Code (Act No. 89/2012 Coll.), as amended, and by the Act on Consumer Protection (Act No. 634/1992 Coll.), as amended. If the buyer is not a consumer, relationships not governed by the GTC are governed by the Civil Code (Act No. 89/2012 Coll.), as amended.

Purchase Contract
If the buyer is a consumer, the proposal to conclude a purchase contract (the offer) is the placement of the offered goods by the seller on the pages of the online shop. The purchase contract is formed when the consumer sends the order and the seller subsequently accepts that order, which is confirmed by the issue of an invoice/advance invoice or a similar sales document (e.g. a receipt). If this process is not completed by both parties, no purchase contract is formed. The automatic e-mail sent to the buyer after the order has been placed is for information only; it is therefore not considered confirmation of acceptance of the order by the seller and has no bearing on the formation of the purchase contract. A contract that has been formed (including the agreed price) may be amended or cancelled only by agreement of the parties or on statutory grounds.

If the buyer is not a consumer, the proposal to conclude a purchase contract is the order for goods sent by the buyer, and the purchase contract itself is concluded at the moment the seller's binding acceptance of this proposal is delivered to the buyer. Such acceptance is confirmed by the issue of an invoice/advance invoice or a similar sales document (e.g. a receipt).

The seller reserves the right, among other things, to cancel an order or part thereof before the purchase contract is concluded, or to cancel a concluded purchase contract, in the following cases: if, for reasons on the part of third parties, the seller is objectively unable to deliver the goods to the buyer within a period reasonable in the circumstances, and/or the goods are no longer manufactured or supplied, and/or the price charged by the supplier of the goods has changed significantly, and/or the buyer has failed to credibly demonstrate that they meet the statutory requirements for acquiring the goods. If the buyer has already paid part or all of the purchase price, this amount will be transferred back to their account or address without undue delay and the purchase contract will not be concluded.

The seller also reserves the right to cancel an order for goods marked "Temporarily unavailable", "To order", "Discontinued" or similar terms if the goods can no longer be delivered or replaced by another model and/or if their price has changed significantly and the customer does not accept this before the purchase contract is formed. The seller will inform the customer of this situation. If part or all of the order has been paid, the money will be refunded to the customer's account without undue delay.

Before sending the order to the seller, the buyer is able to check and change the data entered in the order (goods, customer information, delivery method, payment method, etc.), including with regard to the possibility of identifying and correcting errors made when entering data into the order. The buyer sends the order to the seller by clicking the button completing the order.

By concluding the purchase contract, the buyer expresses their agreement with these GTC and with the Complaints Procedure, which forms an integral part of these GTC, and confirms that they have duly familiarised themselves with both these GTC and the Complaints Procedure. The buyer is adequately notified of these GTC and the Complaints Procedure before the purchase contract is concluded and has the opportunity to familiarise themselves with both these GTC and the Complaints Procedure in full.

If the order contains goods whose possession or handling is regulated by law or otherwise in the Czech Republic or in the country of the buyer's residence/registered office (e.g. weapons, their main parts, ammunition or pyrotechnics), or whose export from the Czech Republic/EU is regulated, the buyer confirms by sending the order that they meet the relevant requirements for acquiring such goods. The seller is entitled to require the buyer to verify in advance that these requirements are met by presenting the relevant documents, in particular: an identity document, a firearms permit (zbrojní průkaz), a trade concession for activities in the field of weapons and ammunition, a firearms licence (zbrojní licence), an ammunition licence, an accompanying document (průvodní list), or an import/export permit. The seller is also entitled to record and store copies of the documents presented, in accordance with the law. Where a statutory obligation to verify age arises, the seller is entitled to require the buyer (a natural person) to provide, where applicable, merely a credible statement of their date of birth or of information in which the date of birth is contained.

If a gift in the form of a special discount tied to the simultaneous purchase of a specific product or to the total purchase price is provided with a purchase, and withdrawal from the purchase contract, including partial withdrawal, results in the conditions for granting that discount no longer being met, the buyer is obliged to pay the seller the full price, valid at the time the purchase contract was concluded, of the goods they retain.

A gift certificate is a voucher of monetary value issued by the seller. If a gift certificate of a specified value is purchased, any value not used upon redemption is not refunded. Gift certificates may only be used to purchase goods and services and cannot be exchanged back for cash.

If a voucher (ticket) issued by the seller for participation in an airsoft or other similar event is purchased, the seller is not liable to the buyer for any harm to property/health/life that could occur when the voucher is used during the event or during transport to and from the event, for example due to the buyer's insufficient medical fitness, through their own carelessness, through failure to follow the organisers' instructions and/or through the fault of third parties. The buyer must assess the risk individually before purchasing the voucher.

If a voucher (ticket) issued by a clearly identified third party (other than the seller) is purchased, the buyer acquires a claim (voucher) for the delivery of goods or the provision of a service by the issuer of that voucher. The conditions for the delivery of the goods or the provision of the service and the conditions of their use, including the making of complaints, are then governed by the conditions stated on the voucher and by the terms and conditions of the issuer of the voucher. The issuer of such a voucher may be any domestic or foreign natural or legal person carrying on a business.

If the buyer purchases such a voucher (ticket), the seller is not the supplier of the goods in question or the provider of the service and is therefore not liable to the buyer for any harm that may occur in the use of the goods or in receiving the service, for example due to the buyer's insufficient medical fitness or the hazardous nature of the service. The buyer must assess the risk of the selected goods or service individually before purchasing the voucher.

All unused vouchers (tickets) and gift certificates, regardless of the issuer, expire without compensation upon the expiry of their validity date. The organiser reserves the right to change the date. The buyer is entitled to a refund for a paid voucher (ticket) only if the event is cancelled.

Title to the goods passes from the seller to the buyer only upon proper and full payment.

Rights Arising from Defective Performance
The rights and obligations of the contracting parties regarding rights arising from defective performance are governed by the relevant generally binding regulations (in particular Sections 1914 to 1925, Sections 2099 to 2117 and Sections 2161 to 2174 of Act No. 89/2012 Coll., the Civil Code).

The seller is liable to the consumer that the item is free from defects upon receipt. In particular, the seller is liable to the consumer that, at the time the consumer took receipt of the item:

  • the item has the characteristics agreed between the parties and, in the absence of such agreement, the characteristics described by the seller in its offer or expected by the buyer with regard to the nature of the goods and on the basis of advertising carried out by the seller,
  • the item is fit for the purpose stated by the seller for its use or for which an item of this kind is usually used,
  • the item corresponds in quality or workmanship to the agreed sample or model, if the quality or workmanship was determined according to an agreed sample or model,
  • the item is in the appropriate quantity, measure or weight, and
  • the item complies with the requirements of the legal regulations in force in the Czech Republic.

If the item does not have the above characteristics, the consumer may also demand delivery of a new item free from defects, unless this is disproportionate given the nature of the defect; however, if the defect concerns only a component of the item, the consumer may demand only the replacement of the component; if this is not possible, the consumer may withdraw from the purchase contract. If, however, this is disproportionate given the nature of the defect, in particular if the defect can be remedied without undue delay, the consumer has the right to have the defect remedied free of charge. The consumer also has the right to delivery of a new item or replacement of a component in the case of a remediable defect if they cannot use the item properly due to the repeated occurrence of the defect after repair (upon the fourth and any subsequent consecutive acknowledged warranty defect on the same item) or due to a greater number of defects (upon the third and any subsequent acknowledged identical warranty defect on the same item). In such a case, the consumer also has the right to withdraw from the contract.

If the consumer does not withdraw from the contract or does not exercise the right to delivery of a new item free from defects, to replacement of a component or to repair of the item, they may demand a reasonable discount. The consumer is also entitled to a reasonable discount if the seller is unable to deliver a new item free from defects, replace a component or repair the item, as well as if the seller fails to remedy the situation within a reasonable time or if remedying the situation would cause the consumer considerable difficulties.

The buyer is not entitled to rights arising from defective performance if:

  • the buyer knew before taking receipt of the item that it had a defect, or if the buyer caused the defect themselves,
  • in the case of an item sold with a defect, in respect of the defect identified at the time of sale and of any defect that this defect could subsequently cause to the item,
  • in respect of wear and tear of the item caused by its normal use,
  • in respect of the further service life of the item, if the declared service life has already been exhausted,
  • in the case of a used item, in respect of a defect corresponding to the degree of use or wear that the item had when taken over by the buyer,
  • or if this follows from the nature of the item (for example, an item of a consumable nature).

The consumer is entitled to exercise the right arising from a defect that occurs in new consumer goods within 24 months of receipt. If a defect becomes apparent within six months of receipt, the item is deemed to have been defective at the time of receipt, unless proven otherwise. Goods are considered as-new if they may have been tested in advance or used for a short time and may bear aesthetic traces of such use, provided that these traces do not affect usability and the goods are fully functional. Goods are considered used if they have been used and bear signs of previous use, but are fully functional and all necessary accessories are always included in the package.

For as-new goods, the period for the consumer to exercise the right arising from a defect is shortened in accordance with Section 2168 of the Civil Code to 21 months, and for used goods to 12 months from receipt.

Unless stated otherwise for individual goods or in a concluded commercial (supplier–customer) contract, the seller provides a person purchasing within the scope of their business activity with a quality guarantee of the same duration as if the purchase had been made by a consumer.

If the buyer does not notify the seller of a defect without undue delay after they could have discovered it through a timely inspection and with sufficient care, the seller is entitled to refuse the buyer the right arising from defective performance. In the case of a hidden defect, the same applies if the defect was not notified without undue delay after the buyer could have discovered it.

The running of the period for settling complaints is suspended if the seller has not received from the buyer all the documents and materials needed to settle the complaint (for example, certain essential parts of the goods, proof of purchase of the goods, or other documents). The seller is obliged to request the buyer to supply the missing documents and materials as soon as possible. The period is suspended from that date until the requested documents and materials are supplied by the buyer.

Further rights and obligations of the parties relating to the seller's liability for defects are governed by the seller's Complaints Procedure.

No rights of the buyer may be exercised in respect of gifts provided entirely free of charge. Such goods meet the conditions of a gift contract and are governed by the applicable and effective legal regulations on gift contracts. The gift contract between the seller and the consumer is concluded subject to the condition subsequent that, if the purchase contract is withdrawn from, the buyer is obliged to return the gifts provided to the seller together with the purchased goods.

Withdrawal from the purchase contract as a result of a defect: The buyer may not withdraw from the contract or demand delivery of a new item if they are unable to return the item in the condition in which they received it. This does not apply if:

  • the change in condition occurred as a result of an inspection necessary to identify the defect in the item,
  • the buyer used the item or its parts before the defect was discovered.

Specified Service Life
In accordance with the technical parameters set by the manufacturers, the seller has the right to specify the technical service life of specific products or categories of products, provided that the specified regime of their use and storage is observed.

The service life of the internal parts of manually cocked (spring) airsoft guns and gas airsoft guns made of plastic and metal that are subject to operational wear, such as bolts, bolt guide rails, springs, cylinders, pistons, piston catches, trigger and safety mechanisms, feed and hop-up chambers, internal magazine mechanisms and barrels, is 5,000 rounds.

The service life of the mechanical and electrical parts of electric (AEG) airsoft guns made of metal and plastic that are subject to operational wear, such as gearboxes, all internal gearbox parts, electric motors, wiring, hop-up chambers, barrels and recoil simulation systems, is specified as 30,000 rounds at a maximum muzzle energy of up to 1.6 J, 15,000 rounds at a muzzle energy of 1.6 – 2.2 J, and 7,000 rounds at a muzzle energy above 2.2 J. The service life of electric trigger contacts, MOSFET and processor-controlled trigger units and electric motor brushes is specified as 5,000 rounds.

The service life of rubber internal parts and internal parts made of other soft plastics, such as O-rings and other seals, cylinder heads or piston heads and hop-up rubbers, is 5,000 rounds for all types of airsoft guns.

The service life of batteries and rechargeable batteries is specified as 6 months.

The service life of propellant gases is specified as 6 months.

The service life of plastic airsoft BBs is specified as 6 months. The service life of BIO airsoft BBs is specified as 3 months, provided the specified storage conditions are maintained, in unopened packaging from the date of sale, or 1 month from the first opening of the original packaging by the user, whichever occurs first.

Consumer's Right to Withdraw from the Purchase Contract within 14 Days
If the purchase contract is concluded by means of distance communication (in the online shop), the consumer has the right, in accordance with Section 1829(1) of the Civil Code, to withdraw from the contract without giving a reason within 14 days of receipt of the goods. The withdrawal from the purchase contract must be sent to the seller within the above period, otherwise it is invalid.

If the consumer wishes to withdraw from the contract within the 14-day period under the preceding paragraph, they shall contact the seller and, preferably in writing, state that they are withdrawing from the contract, ideally quoting the order number, the date of purchase and the account number for the refund, and at the same time send the returned goods back. The money may also be refunded in cash at the company's registered office or at one of its premises (by prior arrangement). If the order was paid by debit/credit card, the refund must always be made to that card in accordance with the conditions of the debit/credit card issuer.

To withdraw from the purchase contract, the consumer may use, for example, the model form provided by the seller, which forms an annex to these GTC. The consumer may send the withdrawal from the purchase contract, among other means, to the address of the seller's premises or to the seller's e-mail address objednavky@airsoft.cz

If the consumer withdraws from the contract in accordance with the preceding paragraphs, the seller shall refund the funds received (except for the amount representing the additional costs of delivering the goods incurred by the seller as a result of the consumer choosing a method of delivery and payment other than the cheapest method of standard delivery and payment offered by the seller; if the consumer returns only some of the delivered items, the costs of delivering the goods are not refunded) within 14 days of the return of the goods, by transfer to the buyer's account. The seller is also entitled to refund the performance provided to the consumer at the time the goods are returned or by another means, provided the consumer agrees.

However, the statutory provisions on withdrawal from the contract within 14 days cannot be understood as an opportunity for the consumer to borrow the goods free of charge for use. The consumer should therefore return the goods unused, complete and with full documentation, clean, undamaged and in undamaged retail packaging – in the condition and of the value in which they received them.

If the consumer exercises the right to withdraw from the contract within 14 days of receipt of the performance, they must, within 14 days of the withdrawal, hand over to the seller everything they obtained under the purchase contract, including the standard retail packaging of the returned goods, which forms an integral part thereof (retail packaging is the packaging in which the goods are normally offered for sale – it does not mean the outer shipping packaging, for example a box, envelope, bag or film, in which the goods were packed to protect the retail packaging during transport), or those items of the delivered goods that they wish to return to the seller. The consumer is not entitled to damage the retail packaging in any way beyond what is necessary for carefully unpacking the product, nor to modify it. For any return shipment, the retail packaging must therefore be covered with suitable shipping packaging.

If this is no longer reasonably possible (e.g. the goods have in the meantime been destroyed or consumed), the consumer must provide the seller with monetary compensation as consideration for what can no longer be handed over. If the returned goods are damaged or only partially consumed, the seller may assert a claim for damages against the consumer and set off its claim against the purchase price to be refunded. In such a case, the seller is obliged to prove the damage incurred.

If the consumer has returned to the seller only part of the delivered goods, and a discount or a gift was provided to the consumer at the time of sale in respect of the retained goods or part thereof in connection with the returned goods, the seller is entitled to apply the value of the benefit thus provided to the consumer as consideration against the amount to be refunded. In such a case, the seller refunds to the consumer only the purchase price reduced accordingly.

The seller may also set off against the purchase price to be refunded to the buyer its actually incurred costs associated with restoring the goods to their original condition, which it must prove to the consumer.

The consumer bears in full their own costs associated with returning the goods.

In accordance with Section 1837 of the Civil Code, the consumer does not have the right to withdraw from the contract in particular in the case of contracts:

  • for the provision of services, if they were performed with the consumer's prior express consent before the expiry of the withdrawal period and the seller informed the consumer before the conclusion of the contract that in such a case they have no right to withdraw from the contract,
  • for the supply of goods or services whose price depends on fluctuations in the financial market independent of the seller's will and which may occur during the withdrawal period,
  • for the supply of goods that have been modified according to the consumer's wishes or for their person,
  • for the supply of goods that are perishable, as well as goods that have been irreversibly mixed with other goods after delivery,
  • for repair or maintenance carried out at a place specified by the consumer at their request; this does not apply, however, in the case of the subsequent performance of repairs other than those requested or the supply of spare parts other than those requested,
  • for the supply of goods in sealed packaging which the consumer has removed from the packaging and which cannot be returned for hygiene reasons,
  • for the supply of an audio or video recording or a computer program, if the consumer has broken their original packaging,
  • for the supply of newspapers, periodicals or magazines,
  • for accommodation, transport, catering or leisure activities, if the entrepreneur provides such performance on a specified date,
  • concluded on the basis of a public auction under the act governing public auctions
  • for the supply of digital content, if it was not supplied on a tangible medium and was supplied with the consumer's prior express consent before the expiry of the withdrawal period and the entrepreneur informed the consumer before the conclusion of the contract that in such a case they have no right to withdraw from the contract.

If the withdrawal from the purchase contract is invalid or if, for any of the above reasons, the goods cannot be returned by the consumer, the consumer bears in full the seller's costs associated with sending the goods back to the buyer.

Prices
All prices are contractual. The online shop always publishes valid and current prices. Prices are published as final prices including VAT; VAT is itemised in the order summary. Promotional prices apply while stocks last or until the promotional offer ends. Errors in published prices are reserved.

Registration of Sales
Pursuant to Act No. 112/2016 Coll., on the Registration of Sales, as amended (hereinafter referred to as the "Act on the Registration of Sales"), the seller is obliged to issue a receipt to the buyer. At the same time, the seller is obliged to register the received sale with the tax administrator online; in the event of a technical failure, within 48 hours at the latest.

The seller issues receipts under the Act on the Registration of Sales in electronic form sent by e-mail or in paper form, depending on the chosen payment method and method of transport.

Ordering and Order Verification
The buyer may order goods independently or with the assistance of a member of the seller's staff:

  • via the seller's online shop (www.airsoftshop.cz)
  • by e-mail at objednavky@airsoft.cz
  • in person at the seller's premises
  • by telephone using the seller's stated contact details.

If the buyer agrees to the use of means of distance communication when concluding the purchase contract, the costs incurred by the buyer in using means of distance communication in connection with the conclusion of the purchase contract (costs of internet connection, costs of telephone calls) are borne by the buyer.

Before processing an order received at a distance, the seller verifies it. Verification is carried out by telephone on the buyer's stated contact telephone number; if the buyer cannot be reached, a request to verify the order is sent to the buyer by SMS and e-mail. Orders sent by a verified customer are automatically considered verified. Orders for personal collection and orders paid in advance by bank transfer are not verified in advance, unless some complication is associated with their processing.

Order verification serves in particular to verify that the statutory conditions for acquiring goods whose possession is regulated by law in the Czech Republic are met, to verify the customer's details and addresses, to verify the correctness of the order and to confirm the chosen method of delivery and payment.

Payment Terms
The seller accepts the following payment methods or combinations thereof:

  • payment in cash at the time of purchase, or in advance as a deposit for goods or services
  • payment by debit or credit card at a terminal or online
  • payment in advance by bank transfer to the seller's designated account held in CZK, EUR or USD
  • payment by invoice with a due date (only in specially agreed cases)
  • payment in instalments (only in specially agreed cases)
  • payment by gift certificate issued by the seller

If the buyer chooses in the order a combination of personal collection at the seller's shop and payment of the purchase price in advance (regardless of the payment method), the seller is entitled to verify the buyer's identity against an identity document when the goods are collected.

Delivery Terms
By placing an order, the customer incurs a statutory obligation to take receipt of and pay for the ordered goods, including where the goods are sent cash on delivery (COD).
The seller always dispatches all goods, or prepares them for personal collection by the buyer, at the earliest possible date. The customer is kept informed of the status of dispatch and of the preparation of the goods for personal collection.

Goods are sent by the seller via postal services or contracted carriers. Transport and postal rates are stated and accessible to buyers when choosing the delivery method. Transport of consignments of a specified weight and value to specified destinations is free of charge.

The seller is not liable for damage to the packaging of BBs and gas canisters occurring in transport if these are sent in consignments together with other goods, or in several units in one consignment, unless they are sent in whole cartons.

If part of the ordered goods is not in stock and the buyer agrees to the consignment being split for this reason, the buyer pays the postage or carriage for each separate consignment.

No packaging fee is charged on consignments.

Goods for personal collection may be collected by the customer, after confirmation that they are ready, at the address of the seller's premises (they cannot be delivered to other contracted retailers).

If goods are sent to the buyer abroad (outside the Czech Republic), the buyer is responsible for meeting all statutory conditions for taking receipt of them (including customs clearance, where applicable) in the country of delivery. If delivery of the goods is not possible due to the intervention of the authorities in the country of delivery, the buyer bears all costs associated with the unsuccessful dispatch of the goods, their return and any damage. If the goods are seized or destroyed by the authorities in the country of delivery for failure to meet the statutory conditions for taking receipt of them (including customs clearance, where applicable), the seller's obligation to the buyer is deemed to have been fulfilled and all loss is borne by the buyer.

Uncollected Consignments
If a consignment is returned to the seller as undelivered/uncollected, the buyer will be informed of this situation (by e-mail, SMS or telephone, depending on the available contact details) and asked how they wish to proceed with their order.

If the non-delivery/non-collection of the consignment was not due to an error on the part of the seller or the carrier, and the buyer requests that it be sent again, a handling fee equal to the postage or carriage for the repeated delivery will be added to the price of the consignment. If the consignment is again not delivered/collected through no fault of the seller or the carrier, it will be sent again only after payment has been made in advance by transfer to the seller's bank account.

If the customer does not respond to the notice of non-delivery/non-collection of the consignment or refuses the consignment, we will cancel the order. In this case, the customer will be charged a cancellation fee for the unsuccessful dispatch of the consignment and its packing, equal to the postage/carriage and packaging costs. For standard consignments within the Czech Republic, this cancellation fee is CZK 200. The buyer will be able to make a further purchase from the seller only after paying the full price of the next order in advance by transfer to the seller's account or in advance by payment card, together with payment of the cancellation fee for the previously uncollected consignment.

Take-Back of Electrical Equipment

The seller ensures the take-back of the electrical equipment it sells and the separate collection of electrical waste, batteries and rechargeable batteries in accordance with the relevant legal regulations. The buyer is entitled to return old electrical equipment, batteries or rechargeable batteries to the seller at any of its shops, or to send them back to the seller. The receiving point for such consignments is the seller's service department.

Personal Data Protection

Customers' personal data are processed and stored in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons (hereinafter referred to as the "GDPR") and the legislation of the Czech Republic, in particular Act No. 101/2000 Coll., on Personal Data Protection, as amended.

The buyer has the right of access to their personal data, the right to have them rectified, and the other statutory rights in respect of such data. Personal data may be removed from the database at the customer's request. Customers' personal data are secured against misuse. The seller does not pass customers' personal data to any other person without their consent. Exceptions are external carriers, to whom customers' personal data are passed to the extent strictly necessary for the delivery of the goods, banking companies in connection with the execution of the relevant payments by credit card, payment gateway or bank transfer, and, where applicable, suppliers if this is necessary for handling the complaints process.

Individual purchase contracts and related documents are archived by the seller after their conclusion in electronic or written form and are accessible only to authorised persons – the customer, the operator of the shop and the authorities of the Czech Republic, in accordance with the applicable legislation.

The complete personal data protection statement can be found in the Personal Data Protection document.

Final Provisions

Provisions deviating from these terms and conditions and the related Complaints Procedure may be expressly agreed in the purchase contract, provided they do not conflict with the law. Any such deviating provisions take precedence over the provisions of these terms and conditions and the related Complaints Procedure.

The seller may amend or supplement the wording of these terms and conditions and the related Complaints Procedure. This does not affect the rights and obligations that arose during the period of effect of their previous wording.

The seller handles consumer complaints via the e-mail address bas@airsoft.cz. The seller will send information on the handling of the buyer's complaint to the buyer's e-mail address.

Any disputes between the seller and the buyer may also be resolved out of court. In such a case, the buyer who is a consumer may contact an alternative dispute resolution body, such as the Czech Trade Inspection Authority (ČOI). More information on out-of-court dispute resolution can be found here. Before proceeding to out-of-court dispute resolution, the seller recommends that the buyer first use the above contact details of the seller in order to find an amicable solution to the situation.

The seller is authorised to sell goods on the basis of a trade licence and the relevant trade concessions in the field of weapons and ammunition. Trade licensing inspections are carried out within its remit by the competent trade licensing office. Supervision of personal data protection is exercised by the Office for Personal Data Protection. The Czech Trade Inspection Authority (ČOI) and the Czech Proof House for Arms and Ammunition exercise supervision over defined areas of business.

These GTC apply in the wording published on the seller's website on the day the purchase contract is concluded. Once confirmed, the consumer's order is archived as a concluded contract between the buyer and the seller for the purpose of its performance and further record-keeping, and its status is accessible to the buyer. The contract may be concluded in Czech or, where applicable, in other languages, provided this does not make its conclusion impossible. By making a purchase, the customer agrees to receive commercial communications.

These GTC allow the consumer to archive and reproduce them. At the moment the purchase contract is concluded, the buyer accepts all provisions of the GTC in the wording valid on the day the order is sent, including the price of the ordered goods stated in the confirmed order, unless demonstrably agreed otherwise in a specific case. The GTC are drawn up in Czech; in the event of their translation, the Czech wording prevails.

These GTC take effect on 1 April 2021.
